Au Bénin, la loi permettant aux afro-descendants d’être naturalisés a été promulguée le lundi 2 septembre 2024. Le gouvernement béninois a publié le mercredi 20 novembre le décret d’application qui fixe les modalités d’obtention de la nationalité pour cette catégorie de personnes. Selon cette loi, « les personnes ayant un ascendant africain déporté dans le cadre de la traite des noirs et du commerce triangulaire » peuvent faire une demande de naturalisation.
En effet, cette loi offre la possibilité aux descendants africains d’acquérir la nationalité béninoise.
L’initiative vise à restaurer les liens brisés par l’esclavage et à répondre à la recherche d’identité des descendants à travers le monde. Cette naturalisation vise également à renforcer les relations diplomatiques et économiques du Bénin avec la diaspora.
Selon cette loi, « les personnes ayant un ascendant africain déporté dans le cadre de la traite des noirs et du commerce triangulaire » peuvent faire la demande de naturalisation béninoise. Également, il faut « avoir dix-huit ans révolus » et apporter la preuve de son afro descendance.
Si un dossier formulé par un afro-descendant depuis l’étranger reçoit un avis favorable, il lui est délivré une attestation provisoire de nationalité valable pendant 3 ans. Pour obtenir un certificat définitif, le demandeur a l’obligation de séjourner au moins une fois sur le territoire béninois.
La nationalité accorde le droit d’entrer, de séjourner et de sortir librement, ainsi que l’accès à un passeport. Le décret ne précise pas ces points, mais il est clair que la personne naturalisée ne peut ni voter ni occuper un poste dans la fonction publique.
