La Cour de Cassation Française a rejeté, mercredi, le pourvoi de Nicolas Sarkozy contre sa condamnation par la Cour d’Appel de Paris en mai 2023. Il a été condamné à trois ans de prison, dont un an ferme sous bracelet électronique, pour corruption et trafic d’influence dans l’affaire des « écoutes ».
L’avocat de Nicolas Sarkozy, Me Patrice Spinosi, a indiqué que son client se conformerait aux sanctions prononcées la sanction, mais qu’il saisirait la Cour Européenne des Droits de l’Homme (CEDH) dans les semaines à venir. Cette saisine n’empêche néanmoins pas l’exécution des sanctions prononcées.
Nicolas Sarkozy, 69 ans, est également condamné à trois ans d’inéligibilité.. Il sera convoqué dans un délai d’un mois devant un juge de l’application des peines pour déterminer les modalités de son bracelet.
Cette décision survient alors que Nicolas Sarkozy doit comparaître à partir du 6 janvier devant le tribunal de Paris pour répondre aux accusations de financement libyen de sa campagne présidentielle de 2007.
Dans l’affaire Bismuth, l’ex-président avait été reconnu coupable, le 17 mai 2023, d’avoir conclu un « pacte de corruption » en 2014 avec son avocat Thierry Herzog et le magistrat Gilbert Azibert. En échange d’informations et d’influences sur un recours lié à l’affaire Bettencourt, ils avaient promis leur aide pour obtenir un poste à Monaco. Les trois hommes ont été condamnés à la même peine, incluant une interdiction de pratiquer pendant 3 ans pour l’avocat. Malgré leurs revendications d’innocence, leurs pourvois ont été examinés le 6 novembre et rejetés par la Cour de cassation, qui a confirmé la condamnation.
